International Civil Service Law
Pietrangeli Law Firm provides assistance to officials and external consultants of International Organizations regarding employment relationship issues and social security matters.
We examine each case considering the Staff Regulations, the Staff Rules and the Manual (if any) of the International Organization concerned, as well as the general principles of international civil service law as interpreted by the case-law of International Administrative Tribunals (or by the General Court and the Court of Justice of the European Union, depending on each specific case), and the relevant international treaties.
We provide out-of-court advice and assistance in relation to employment relationships or to their termination, including in the framework of internal appeal procedures established by each International Organization and set out in its Staff Regulations and Statute.
Our professionals defend our clients before International Administrative Tribunals and before the General Court and the Court of Justice of the European Union.
As regards the experience acquired over the years, it should be noted that:
➢ Over the years, we have dealt many times with problems relating to the emploment relationship with International Organizations, examining a variety of issues – e.g., failure to renew fixed-term contracts, dismissals, demotion, transfer, disciplinary measures, administrative measures, sick pay for work-related illness, social security and tax issues – in connection with different types of contracts, such as fixed-term contracts, indefinite-term contracts, indefinite-temporary contracts and special services agreements. We have also handled cases concerning the secondment of civil servants to international organizations.
➢ Pietrangeli Law Firm is one of the very few law firms in Italy whose lawyers are authorized to plead, and have pleaded, before the Administrative Tribunal of the International Labour Organization (ILO) in Geneva (see, for instance, ILO Administrative Tribunal, Judgment No. 3021 of 6 July 2011, Judgment No. 3021 of 6 July 2011, A.C. v. Food and Agriculture Organization of the United Nations (FAO).
